SUBJ: IS THE AFRI BAR GRILL LOUNGE CONSIDERED A PUBLIC SPACE OR A PRIVATE SPACE OPEN TO THE PUBLIC?
The Afri Bar functions as a multiple use land use property that operates year round as a commercial gay establishment established to promote recreation, tourism, working, lodging, and accommodations within a marketed gay demographic within a proposed region of Southern California creating a new gay destination known as the Afri Bar within its own geographical location.
The Afri Bar is a dual purpose, commercial gay establishment, and private Members club “privately owned” by Urban Ground Resort, LLC, that offers their Guests access to the Afri Bar amenities, activities, products, goods, and services which are completely situated on the Afri Bar property and are deemed “privately owned” yet commercially public accessible spaces for the purpose of defining these spaces.
For example, the roads outside of the Afri Bar leading to the entranceway of the Afri Bar are open to the public and are maintained by the municipality in which the Afri Bar may be situated, whereas the Afri Bar entrance and exit ways, and all other infrastructure to include its designated roadways, walkways, and parking areas on the grounds of the Afri Bar is private property, privately owned, operated, and maintained by the Afri Bar and Urban Ground Resort, LLC, open to its designated demographic within the public on an invitational and commercial basis by which entering the Afri Bar premises our Guests agree to abide by our Company rules to ensure a safe and enjoyable experience for all Guests.
The Afri Bar maintains a set of standard operational procedures as general property rules that are an intended and permitted use as a non-exhaustive list. We reserve the right to deny admission, prevent entry or require a person already admitted to leave the Afri Bar or any part thereof, without refund, liability or compensation, for failure to comply with any of these rules, for unsafe, illegal or offensive behavior, to ensure safety, security or order, or if we consider that the circumstances otherwise so require, in our sole and absolute discretion consistent with applicable law.
